Terms of Service

Welcome to OnBharat! These Terms of Service ("Terms") govern your use of the OnBharat website and the IT and software services, including Web Development, Android Applications, School ERP, and Coaching ERP solutions, provided by OnBharat ("Company", "we", "us", or "our"), based in Wazirabad, Delhi.
By accessing our website or utilizing our services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access our services.
1. Provision of SaaS Services (ERPs)
- Domain Mapping: For our ERP clients, we provide the software hosted on our centralized servers. We require clients to point their registered domain to our server IP. You remain the sole owner of your domain name.
- License: We grant you a revocable, non-exclusive, non-transferable, limited license to use the ERP software strictly in accordance with these Terms and your paid subscription plan.
- White-Labeling & Mobile Apps (Google Play Store): Depending on your tier, we provide custom Android applications branded with your institution's name on the Google Play Store. The underlying code and intellectual property of these applications remain the sole property of OnBharat. By downloading and using these apps, users also agree to comply with Google Play's Terms of Service.
2. Client Obligations and Acceptable Use
You agree not to use the Services in any way that violates any applicable local, national (Indian), or international law or regulation. Specifically, you agree NOT to:
- Host, display, upload, modify, publish, transmit, store, update, or share any information on our ERPs that belongs to another person and to which you do not have any right.
- Upload content that is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, or otherwise unlawful in any manner whatever under the Information Technology Act, 2000.
- Attempt to decompile, reverse engineer, extract the source code, or maliciously modify any OnBharat software, website, or Android application (APK) distributed via the Google Play Store or otherwise.
3. Payments, Billing, and Renewals
Clients utilizing our continuous IT services or SaaS products will be billed according to the agreed-upon billing cycle (monthly, annually, etc.). Failure to pay within the stipulated grace period may result in the suspension of your ERP dashboard and apps until dues are cleared.
4. Intellectual Property Rights
Except for the data you input into the ERP systems (Client Data), all intellectual property rights in the software, website, architecture, databases, and UI/UX belong exclusively to OnBharat. Your subscription is a right of use, not a transfer of ownership.
5. Limitation of Liability
To the maximum extent permitted by Indian Law, OnBharat shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service.
6. Governing Law & Jurisdiction
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.
7. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any major changes prior to them taking effect.
